AI: Complex Emerging Regulatory and Risk Concerns

While AI is presenting intriguing opportunities for productivity and innovation, the tech world must grapple with serious regulatory, legal and related policy considerations, said privacy, security and legal experts Benham Dayanim, Patricia Titus and Heather West in this CyberEdBoard talk.

Currently, the United States has no federal AI regulatory legislation in the pipeline, said Dayanim, partner and global head of digital commerce and gaming at Orrick, Herrington & Sutcliffe LLP. So, one critical question is whether policymakers might regulate AI by "overweighing risks and underweighting benefits, he said.

Yet at the same time, "AI as a broad umbrella term is not particularly useful for a regulatory regime," said West, senior director of cybersecurity and privacy services at Venable LLP.

Titus, chief privacy and information security officer at Markel Corp., also has concerns. The output of AI is only as good as the data that is fed in, she cautioned, and "people are going to start making risk-based decisions around data that may not be accurate."

"But if we govern too much, we're going to stifle innovation," Titus added. "As companies, we have to figure out what's ethical and responsible as we're using this new capability."
